Vacancy by removal or default

I for one am refusing to drink the Kool Aide that has been served year after year by our elected officials and their friends.

"Section 25-1-59 Vacancy by removal or default.

If any state, district, county, county district, or municipal officer during the term of his office shall remove out of the state, district, county or municipality for which he was elected or appointed, such office shall thereby become vacant and the vacancy be supplied as by law directed."

In August 2009, this Committee asked the Board of Supervisors (Beat 1, Beat 3, Beat 4 and Beat 5) to vote to remove the Beat 2 Supervisor from his seat and to hold a Special Election for his replacement. There was no response from any of the Supervisors.

Beat 2 Supervisor




I believe anyone who is seeking political office needs to have both feet firmly planted in the district they wish to represent.



Not only do I believe this, it is also the law.



I live in Beat 2 in Tunica County, MS.


In November 2008, I founded Tunicans for Transparency in Government. The mission of this grassroots effort has been to “help make Tunica County a better place to live and work for all of our citizens and not just the few.”


My decision to run for political office is based on some of the changes I believe need to take place in Tunica County to move our community forward. Each resident needs to be represented and each resident needs to have a voice in their government.


If it is your choice to elect me as your Beat 2 Supervisor, I am making the following promise:



"I will hold a monthly Beat 2 meeting on the last Monday of every month at 7 p.m. for the purpose of hearing your concerns. I will listen and I will take appropriate action. This meeting will give each Beat 2 resident a voice in their local government."



If it is your choice to elect me as your Beat 2 Supervisor, I will start by making the following motions at the first Board of Supervisors’ Meeting in 2012:



1. I will make a motion to hold the first monthly meeting of the Board of Supervisors in the evening of the first Monday of every month.



2. I will make a motion to have written job descriptions for each Tunica County Employee completed and delivered to the Board of Supervisors by 31 Mar 2012.



3. I will make a motion to bring the Healthcare Authority into the mainstream of Tunica County Government. This department will make reports at the first monthly meeting of the Board of Supervisors. This action will eliminate separate bookkeeping and Healthcare Authority reports will be made a part of the Board of Supervisors’ Minutes.



4. I will make a motion to have each department head deliver their monthly report in person at the first monthly meeting of the Board of Supervisors.



5. I will make a motion to eliminate the need of residents having to go through the County Administrator to be placed on the Board of Supervisors’ Agenda.



I am soliciting your vote for Beat 2 Supervisor. If it is your choice to elect me, it will be my full time job to be your Supervisor.

It's safe to go back in the water...

Finally, the drains required by the Virginia Graeme Baker Pool and Spa Safety Act have been purchased and installed in both pools at the Aquatic Center. We’ve seen the certificates for the drains and have a copy of the claim paying for the installation. So, this should be a done deal. Maybe.

This is what has happened: In Jan 2009, members of the Transparency Committee became aware of the above Federal Law. The deadline for compliance with this 2007 law was 31 Dec 2008. This meant that if Safe Drains were not installed as of 31 Dec 2008, the pools were to be closed until the drains were installed. There was no wiggle room. When we found out about this law, we were already out of compliance.

The very morning we found out about this law, the Board of Supervisors’ were having a meeting and we placed a copy of this law at the place of each Supervisor.

In Feb 2009, the Transparency Committee provided grant information to the Board that would have helped offset the expenses of purchasing and installing these drains. This information was placed at the President of the Board of Supervisors place in the Board Room. After the meeting, I personally asked the President of the Board if he had seen what was at his place when he arrived. The response was yes but he hadn’t had a chance to read it yet. There was acknowledgement that he would read the information as soon as he had a chance.

And then the nagging and complaining from our Committee continued for the next year and eight months. During this time, we held two Summer Camps; don’t know how many swim practices and meets and can’t even imagine how many people just enjoying our beautiful pools.

What were we to do? We got tired of talking about this month after month at our meeting. We got tired of asking our Supervisors. The State of MS couldn’t help us because this was a Federal Law. So, in the spring of 2010, we filed a complaint with a Federal Agency to make our County Government comply with this mandate. Let’s hope this is a done deal and we won’t be looking at a federal fine for a year and eight months of being out of compliance with a Federal Law.
